What is a GDPR Article 27 representative?
It is a person or company established in the EU that a non-EU business appoints in writing to act as its point of contact for EU supervisory authorities and data subjects. The representative also holds the business’s Article 30 records of processing. EU Shield provides this service for a flat annual fee of €490.
Do I need one if I just run a website, app or SaaS?
If your business has no establishment in the EU but offers goods or services to people in the EU or monitors their behaviour (analytics, tracking, personalisation), Article 27 applies to you. A narrow exemption exists for processing that is only occasional, involves no large-scale special-category data, and is unlikely to result in a risk — but ongoing users, customers or subscribers in the EU are not “occasional”.
What happens if I don’t appoint a representative?
Failing to appoint a representative is itself an infringement of the GDPR, subject to fines of up to €10 million or 2% of total worldwide annual turnover, whichever is higher. In practice it also leaves your privacy policy incomplete, which enterprise procurement teams and privacy audits increasingly flag.
Is an EU representative the same as a Data Protection Officer (DPO)?
No. A DPO is an internal advisory role that monitors your compliance; an EU representative is your external EU-based point of contact under Article 27. They are separate roles under separate articles of the GDPR, and regulators consider them incompatible with each other. Many businesses need a representative but no DPO.
