GDPR for B2B Companies — No, B2B Is Not Exempt
Does B2B exemption exist in GDPR? No. B2B companies also process personal data. Article 27 applies to B2B. EU Rep from EUR 490/yr.
One of the most persistent GDPR misconceptions is that B2B companies are somehow exempt because they “only deal with businesses, not consumers.” This is incorrect. GDPR protects individuals — natural persons — regardless of whether they act in a personal or professional capacity.
Why B2B Companies Are Not Exempt
Under GDPR Article 4(1), personal data is defined as any information relating to an identified or identifiable natural person. When a B2B company processes the email address, phone number, name, or job title of a contact at another business, that is personal data of a natural person. The context (B2B marketing, procurement, client management) does not change the legal classification.
Examples of B2B Data Under GDPR
- Procurement contacts: Names, emails, phone numbers of EU suppliers’ procurement managers
- Client communications: Email threads, contract negotiations, project management with EU business contacts
- CRM data: Sales leads, account contacts, decision-maker profiles for EU businesses
- B2B marketing: LinkedIn connections, email campaigns to EU business decision-makers, event registrations
- Invoicing: Individual names on invoices, bank account details, billing contacts
Article 27 Still Applies
If your B2B company is outside the EU and processes personal data of individuals in the EU — even if those individuals are business contacts — you must appoint an EU Representative under Article 27. There is no B2B exemption in the GDPR text.
