How Subscriptions Trigger GDPR

Recurring Billing Data

Storing payment method tokens for recurring billing requires ongoing processing. Your payment processor stores the token; you must ensure they have a DPA and your EU Representative is documented.

Retention After Cancellation

How long do you keep cancelled subscriber data? You can retain for service re-activation (reasonable period, e.g., 90 days) plus tax/legal requirements (5-7 years for VAT records). After that, data must be deleted or anonymised.

Marketing to Subscribers

Existing subscribers can receive marketing for similar products under the “soft opt-in” exception. But opt-out mechanisms and granular consent preferences must be maintained.

ROPA for Subscription Businesses

Your Record of Processing Activities should cover: subscriber data collection and processing, billing/transaction data flows, marketing data processing (email campaigns, segment analysis), third-party integrator data flows (Stripe, Klaviyo, HubSpot), and data retention schedules per subscriber lifecycle stage.
