- Israeli companies targeting EU customers or monitoring EU users need Article 27
- Tech, cybersecurity, medical devices, and diamond/trade sectors most exposed
- EUR 490/year — 15-minute setup
Does GDPR Apply to Israeli Companies?
Yes. Israel received an EU adequacy decision in 2011, updated in 2019, allowing free data flow from the EU to Israel without additional safeguards. However, this adequacy decision is limited to cross-border data transfers (Chapter V of the GDPR). It does not exempt Israeli companies from GDPR’s broader obligations — including Article 27’s requirement to appoint an EU Representative.
If your Israeli company offers goods or services to EU residents (a SaaS platform, an e-commerce store, a medical device sold to EU hospitals, or a cybersecurity service for EU companies), or if you monitor the behaviour of EU individuals (through analytics, tracking, or profiling), you are processing EU personal data and must comply with GDPR. Article 27 specifically requires you to designate an EU Representative in writing.
Israel Privacy Protection Law vs GDPR
The Privacy Protection Law 1981 (amended) regulates data processing in Israel but has significant differences from GDPR:
- No mandatory DPO: Not explicitly required under Israeli law as under GDPR
- No 72-hour breach notification: Notification requirements exist but timelines differ
- No Article 27 equivalent: No requirement for a local representative for non-Israeli entities
- Different enforcement: ILITA (Israeli Privacy Protection Authority) enforcement differs from EU DPA mechanisms
- Database registration: Israeli law requires database registration vs GDPR’s accountability principle
Israeli Industries Most at Risk
Tech & cybersecurity: Israel’s Start-Up Nation has thousands of companies with EU users, clients, and partners. SaaS, cybersecurity tools, and enterprise software all process EU personal data.
Medical devices & HealthTech: Israeli medical device and digital health companies selling to EU hospitals or clinics. Patient data, clinical data, and device telemetry — all personal data.
Diamond & precious stones: Israel is a global diamond trading hub. EU buyer contact data, transaction records, and logistics data.
