Hong Kong EU Representative
GDPR Article 27 compliance for Hong Kong businesses. Hong Kong PDPO does not satisfy GDPR. EU Representative from €490/yr.

- Hong Kong PDPO does NOT satisfy GDPR — you need separate EU compliance
- Any Hong Kong company with EU customers, users, or data subjects needs Article 27
- Financial services, e-commerce, and trading companies are most exposed
- EUR 490/year flat fee — 15-minute setup, no EU office required
Does GDPR Apply to Hong Kong Companies?
Yes — unequivocally. Despite Hong Kong’s unique status as a Special Administrative Region of China, GDPR applies to Hong Kong businesses just as it applies to any other non-EU entity. Under Article 3(2) of the GDPR, any organization outside the European Union that offers goods or services to individuals in the EU, or monitors their behaviour, falls under GDPR jurisdiction — regardless of its location or legal status.
Hong Kong’s own Personal Data (Privacy) Ordinance (PDPO) is a respected data protection framework, but it does not satisfy GDPR requirements and has not received an EU adequacy decision. Hong Kong companies processing EU personal data must comply with both PDPO and GDPR — and, critically, must appoint an EU Representative under Article 27.
Whether you run a Hong Kong-based e-commerce store shipping to London, a fintech platform with EU users, a trading company with EU business partners, or a SaaS company with EU subscribers — GDPR applies to your data processing activities.
Hong Kong Data Protection vs GDPR
The PDPO and GDPR have significant structural differences. While the PDPO covers six data protection principles, GDPR has a far broader scope covering 99 articles. Key gaps include:
- No mandatory DPO: PDPO does not require a Data Protection Officer; GDPR does for certain processing activities
- No mandatory breach notification: PDPO has no equivalent to GDPR Article 33 (72-hour breach notification)
- Limited enforcement: PDPO maximum fine is HKD 50,000 (~EUR 5,500) vs GDPR maximum of EUR 20 million or 4% of global turnover
- No extraterritorial scope: PDPO primarily applies to data users in Hong Kong; GDPR explicitly applies to non-EU entities targeting EU data subjects
- No right to erasure: PDPO has limited deletion rights vs GDPR Article 17’s “right to be forgotten”
Hong Kong Industries Most at Risk
Financial services & trading: Hong Kong is a global financial hub. Banks, brokerages, insurance firms, and trading companies routinely process EU client data — names, financial information, transaction records, KYC documents. All of this is personal data under GDPR Article 4(1).
E-commerce & retail: Hong Kong-based online stores selling to EU customers. Every order involves EU personal data: shipping addresses, payment info, customer names.
Logistics & shipping: Hong Kong’s port handles massive EU-bound cargo. Logistics companies process EU consignee data, customs documentation, and tracking information.
Tech & SaaS: Hong Kong tech companies with EU users. Analytics, support tickets, billing data.
